"The Hazardous Waste Regulations introduce new and simpler procedures for tracking the movement of waste.

The regulations remove the current need to pre-notify us before hazardous waste can be moved off- site, and include a simpler method for tracking wastes once they have been moved. They include a new system to ensure that certain sites where hazardous waste is produced are notified to us. This will improve the whole regulation of the hazardous waste chain from source site to waste site.

These new regulations will allow us to focus even more on tackling waste at source, to provide advice and guidance to hazardous waste producers and target those that do not comply with environmental requirements.

The changes to the system will enable us to deploy staff from administrative to front-line compliance assessment and enforcement in the field. The national teams providing the customer interface will help to provide a more consistent service. Combining this with new IT systems that will provide intelligence from registration/consignment data we will be able to better target priority waste streams and business sectors. The introduction of sending in quarterly summaries of consignment notes rather than individual ones will simplify the process for the waste management industry. The ultimate objective is to improve waste management which will lead to better protection of the environment and human health."

If you produce Hazardous Waste...

  • You must register with the Environment Agency (some exemptions apply)
     
  • You must produce a Duty of Care transfer note for all movements of Hazardous Waste.  This must include details of all the hazards associated with the waste(s) being moved.
     
  • You must determine and specify the appropriate EWC codes for all wastes you produce.
     
  • Your costs from disposal of Hazardous Waste have already tripled in 2004 as a result of the Landfill Directive preventing co-disposal.  Costs are expected to double again during 2005 as alternative disposal methods are adopted.
     
  • You are likely to be actively regulated and audited by the Environment Agency.  Non-compliances may result in spot-fines or legal action through the courts.

If you receive Hazardous Waste....

  • You must send a Consignee Return to the producer for all shipments you receive.  There are time limits on how quickly you must do this.
     
  • You complete a Hazardous Waste Return quarterly, listing all hazardous waste received in the period and from whence it came.  Paper filing costs £19 per shipment, electronic filing is approximately half price.
